2. MLS/IDX Listing Data Disclaimer

Property listing data displayed on the Site is provided through an Internet Data Exchange (IDX) feed licensed from the Golden Empire MLS, Inc. (GEMLS) and its participating brokers, via the GEMLS RESO Web API. Listings are shown subject to each listing broker's IDX display permissions and are refreshed periodically — they are not guaranteed to be real-time.

All data, including all measurements and calculations of area, is obtained from various sources and has not been, and will not be, verified by broker or MLS. 3. User Accounts

To save homes, like listings, or request showings tied to your history, you'll need a buyer account. You agree to:

• Provide accurate, current information when you register (name, email, phone);
• Keep your password confidential and not share your account with others;
• Notify us promptly if you suspect unauthorized access to your account; and
• Be responsible for all activity that occurs under your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.

4. Prohibited Uses

You agree not to:

• Scrape, harvest, "frame," republish, or systematically download listing data or other Site content outside of normal, individual browsing, or use the Site to build a competing listing database;
• Reverse-engineer, decompile, or attempt to extract the source code of the Site, except as permitted by law;
• Use the Site to transmit spam, unsolicited advertising, or malicious code;
• Submit false or misleading information when registering an account or requesting a showing;
• Interfere with or disrupt the Site's servers, security, or normal operation; or
• Use the Site for any unlawful purpose, including in a manner that would violate fair housing laws.

5. Intellectual Property

The Site's design, text, graphics, logos, and software are owned by SearchKern.com or its licensors and are protected by copyright and trademark law. MLS listing data, including photographs, remains the property of GEMLS and the respective listing brokers and is displayed under license via IDX — it may not be copied, redistributed, or used to create a derivative real estate database. "SearchKern.com" and associated logos are trademarks of [Brokerage Legal Name]; you may not use them without our prior written permission.

6. Third-Party Links

The Site may link to third-party websites — for example, local news articles on our Local News page, or external mapping and font services. We don't control and aren't responsible for the content, accuracy, or privacy practices of third-party sites, and linking to them doesn't imply our endorsement.

7. Limitation of Liability

The Site and all listing data are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, SearchKern.com, its agents, and its brokerage will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising from your use of, or inability to use, the Site or reliance on any listing information displayed on it. You agree to indemnify and hold harmless SearchKern.com, its brokerage, agents, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

9. Governing Law & Changes to These Terms

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Kern County, California. We may revise these Terms from time to time; the "Effective" date at the top of this page reflects the most recent update.
